An Introduction to American Administrative Law
American Administrative Law has been long developed from common law heritage of England. In broad sense, administrative law might be defined as legal control of government. More specifically, it consitsts of the legal principles that defines the authority and structure of administrative agencies, specifies the procedural formalities that agencies use, detemines the validity of administrative decisions and outlines the role of reviewing courts, and other organs of goverment in their relations to administrative agencies.
Those principles include three basic bodies of law: (1) constitutional law; (2) statutory law which includes the Administrative Procedure Act (APA); (3) a form of federal common law, embodied in judicial decisions.
In the democracy system, the citizens elect their representatives to protect their general will, so-called, public interest. They act as legislator who enact the law to govern the citizen's activities in the day-to-day life. However, bureaucracy is the principal mechanic to run the system, so-called administrative agencies. Legislative function will delegate their powers to administrative agencies to enact the regulation to control, support, or prevent some people's activities.
There are several arguments if the regulation should be set up. Most lawyers consider that the regulatory system is necessary in the democracy administration although the administrative agencies are not the direct representatives of the citizen. The economists consider the regulations are indispensable but only when the market has completely failed for the citizens to bargain one another. In short, when the market defects fall within one of following categories, the administrative agencies can justify the regulation formation:
(1) The need to control monopoly power. Under this situation, regulation is required to achieve the allocation of resource efficiently, that is, the regulation is indispensable to achieve the fairness of income distribution;
(2) The need to compensate for inadequate information. Basically, the people will be considered as the "risk optimists;"they tend to believe that they have below-average susceptibility to risks because they lack the complete information. The regulation will play the role to compensate for inadequate information, or to lower the costs ot consumers or workes of obtaining adequate information.
For this reason, the government action may be justified when (1) suppliers mislead consumers whose available legal remedies such as private litigation are expensive; (2) consumers cannot readily evaluate the information available such as the potential effectiveness of a drug; (3) the market on the supply side fails to furnish the information needed or demanded;
(3) Collective action problem. The clearest cases involve public or collective goods, which are characterized by two features: (1) nonrivalous consumption (consumption by one person does not create more scarcity for other consumptions); (2) nonexcludability (every can access public goods). The government can set the standard for the public goods.
(4) The need to correct for "externalities" or for the existence of "transactions costs" that make bargain difficulty and costly. If the transactions costs is not high, the government should not intervene in such activities.
Government regulaltion might be able to justify some other reasons. The government might need to control the windfall profit of some commodity which the price might increase suddenly.
Sometimes, the government might need to control the excessive competition that lead the small rivals of big companies defunct from the business, and finally the price will go up substantially. The regulation to control the "unfair competition" might be easily issued. Another reason, the government might need to alleviate scarcity especially an item in short supply. Finally, the regulation might need to be enacted to control the administrative agency problems because the agencies might distort the market mechanism by themselves.
However, those reasons are not based on the economic basis because those are justified as a means to enhance the efficiency and reduce the social cost. In stead, those are the method to redistribute the resources from one group to another. As a result, the regulation will cause some people better off while making other people worse off.
There still be numerous reasons to justify the administrative regulation. For example, the regulation can be used as the plan to develop the facility, industries, etc. Sometimes, some regulation might be issued to facilitate or assist the poor under the paternalism idea.
History of American Administrative Law
(1) English Antecedents.
The court had developed the writ of mandamus, writ of prohibition, or the writ to certioria as te mean to control the administraive agency decision after the court built up the doctrines of official privilege based on the exercise of discretionary authority. During the sixteenth and seventeenth centuries, in England, the Tudor and Stuart monarchs had developed powerful administrative tribunals that were used to control the subordinate officials in their relation to the citizenry, as the present French Conseil d'Etat. However, it was cut short by the Glorious Revolution of 1688.
(2) The American Experience to 1875.
The writ and the Chancellor's injunctive power were used as the mechanisms for the control of administrive officials around the first 100 years of the states. The main idea to administrate the country shifted from the state rule, which state had responsibility to allocate the resource, to the marketplace mechanism. The state had very limited power to intrude the private's activities.
(3) 1875-1930: The Rise of Administrative Regulation and the Traditional Model of Administrative Law.
The state attempted to set up the regulatory agency such as Interstate Commerce Commission (ICC) to champion the fairness of the small business. In this period, the regulated firms used the court to block the regulation. Then, the state enacted the statutory provision to supplant the court decision and provided for a trial-type hearing before the regulatory agency to develop a factual record that would serve as the besis for agency action. Thereafter, whenever the statury is not clear about the hearing process, court applied the same a trial-type hearing as the due process requirement. Under this traditional model of administrative law, there are four essential elements as following:
(3.1) The legislature must authorize administrative sactions on priviate persons through rules or standards that limit agency discretion; (3.2) The procedures used by the agency must tend to ensure agency compliance with legislative directives; (3.3) Judicial review must be available to ensure that agencies use accurate and impartial decisionmsking procedure and comply with legislative directives; (3.4) Agency processes must facilitate the exercise of judicial review.
(4) The New Deal and Beyond: 1932-1945.
Franklin D. Roosevelt's New Deal was a watershed for the development of American administrative law. During the condition of the Great Depression, the common law was considered both too much and too little in different situations. It was too much because it protected the property and liberty from governmental revision; it is too little because it did not included basic rights to individual "security." The New Deal sought the broad range of social and economi gaurantees. During this period, two movement occured that is: (1) president posessed the broad power of lawmaking and adjudication; (2) the size and independent regulatory commissions had been founded substantially. However, most of New Deal Plans relating to the economic area were struck down as unconstitutional by the supreme court. Court-packing plan to expand the number of supreme court had been proposed by the president; this fact caused the swing vote and acept the deal as constitutional.
(5) 1945-1962: The Administrative Procedure Act (APA) and the Maturation of the Traditional Model of Administrative Law.
In 1940, the congress proposed the Walter-Logan bill, which would have imposed imposed standardized procedural requirements on federal agencies and mandated a broad availability and scope of judicial review of agency decisions. The president voted against this bill, but he actually in 1939 set up the Committed on Administrative Procedure, which finally in 1946 the Federal Administrative Procedure Act had been adopted in U.S.C. section 551 et seq. Some outlines about APA can be deliniated as following:
Section 551 definitions;
Section 552 requirements for publication of certain rules and regulations, and requires agencies to make other important decision and documents available to the public on request;
Section 553-558 the procedural formalities that agencies must observe in decisionmaking;
for example, section 553 will deal with the rule-making process which requires the involved interest persons can participate in the process and everything must be concluded in the record;
section 556-557 is the modifying of trial-type hearing procedures in rulemaking. In addition, the independent administrative judge and the procecutorial official must be separated under section 554, and 556-557.
Section 701-706 deal with the timing, form, and scope of judicial review.
(6) 1962-1980: The Rights Revolution, Critique of Administrative Process and Administrative Substance, and "Public Interest" Administrative Law.
Many scholars considered that the APA was too stiff or rigid. Under the civil right movent in 1960s, there were requirment of fairness for some group of American increased. Many independent regulatory commissions such as Equal Employment Opportunity Commission (EEOC), have been set up. Congress enacted the statutory deadline or hammer that required the administrative to do in timely limit. The court deal with "welfare" which basically was not the property rights as the new property right and required the trial-type hearing or other procedural formalitie and thorough judicial review.
(7) 1980 to now: Presidential Administration and the Cost-Benefit State?
Since the Reagan administration, the economic analysis about the unit cost for the regulatory formation was applied. Administrative agency must prove that the regulation was complete enought to pass the requirement of cost-benefit balancing test and the agency selected the least-cost solutions from several choices. Since 1980, three developments have been of special importance that is the government has shown an increasing interest in engaging in "Quantitative analysis;"in assessing "Tradeoffs;" and in "Smarter tools." Particularly, the government replaced the command and control regulation with the information disclosure and economic incentives or deregulations.
Another factor that facilitate the administrative law in the United Stated is the United States Supreme Court. The Court has played the significant role to develop not only the constitutional issue, but build up the administrative Law as well. First of all, the Court ruled that the agencies have the conderable freedom from judicial review when they decide not to take certain kinds of action. Secondly, the court limits the extent to which the courts can impose new procedural requirements on agencies.
Lastly, the Court requires the lower courts to pay particular attention to agency interpretations of statutes. For instance, if the statutory provisions are unclear, the court will look into the Congress' intention and other background, and reserve the right to interpret the magic words in the statute.
In contrast, if the terms in the statute are defined and clear, the court will not intervene an agency interpretation unless it is obviously unreasonable.

สภา Congress สหรัฐฯ และ Cyberspace crime
หัวข้อเรื่องวันนี้ (๒๐ มกราคม ๔๙) ความจริง ไม่มีเนื้อหาที่เกี่ยวข้องกันมากนัก เพียงแต่อยากจะบันทึกเรื่องที่ฟัง อ่าน และพบมา ไว้เท่านั้นครับ
เรื่องแรก คือ เมื่อคืนก่อน (๑๙ มกราคม ๔๙) ผมไม่ได้ฝันบ้า ๆ บอ ๆ อีกหรอกครับ .... (เขาว่ากันว่า คนเราฝันทุกคืน ๆ ละหลายเรื่อง แต่เราจำไม่ได้) แต่ผมดูรายการโทรทัศน์ C-SPAN2 <ท่านที่สนใจ ลองเข้าชมที่เวปไซต์ c-span.org ได้ครับ> ซึ่งเป็นรายการที่ถ่ายทอดการดำเนินการของสมาชิกรัฐสภาสหรัฐ หรือ สภา Congress จึงมีเรื่องมาเขียนเล่าให้ฟังกัน
สำหรับรายการดังกล่าวนี้ คณะกรรมาธิการของรัฐสภา ที่ศึกษาเกี่ยวกับการปกป้องเด็กและเยาวชน ได้เชิญ ผู้แทนสำนักงานตำรวจสอบสวนกลาง หรือ F.B.I. และ ผู้แทนสำนักงานอัยการสูงสุด (Attorney General) รวมทั้งผู้แทนของบริษัทเอกชนที่เป็นผู้ประกอบการให้บริการทางอินเตอร์เน็ต เช่น บริษัทอเมริกันออนไลน์ (A.O.L.) ไปร่วมชี้แจงเกี่ยวกับการดำเนินการตามกฎหมายในเรื่องต่าง ๆ เรื่องที่ผมดู เป็นเรื่อง การดำเนินการตามกฎหมาย เพื่อการป้องกันเด็กและเยาวชน จากการถูกแสวงประโยชน์ทางเพศ ไม่ว่าเป็นเรื่อง การเผยเผยแพร่ภาพโป๊ของเด็ก หรือสื่ออื่นๆ ที่มีกิจกรรมทางเพศมาเกี่ยวข้องกับเด็ก ทั้งบนโลกอินเตอร์เน็ต หนังสือปลุกใจเสือป่า ภาพ หรือ สิ่งอื่น ๆ ในทำนองเดียวกัน
ตามกฎหมายสหรัฐฯ การเผยแพร่ภาพเด็ก ในทำนองจะสื่อไปในทางเพศ เป็นเรื่องต้องห้าม และมีความผิดร้ายแรง การต้องห้ามนี้ รวมไปถึง ภาพการ์ตูนที่เป็นเด็กด้วย ผู้กระทำการผลิต ตัดต่อ เผยแพร่ ภาพดังกล่าว ไม่ว่าจะเป็นภาพเด็กจริง ๆ หรือ ภาพโป๊ของเด็กที่เป็นภาพการ์ตูน หรือภาพจินตนาการ รวมไปถึงผู้ช่วยเหลือ และผู้ให้บริการอินเตอร์เน็ตที่มีส่วนเผยแพร่สิ่งลามกดังกล่าว ล้วนมีความผิดตามกฎหมายอย่างร้ายแรงทั้งสิ้น
หลังจากมีการรายงานผลการดำเนินการโดยผู้แทนฝ่ายรัฐฯ แล้ว คณะกรรมาธิการ เพื่อเด็กและเยาวชนของสหรัฐฯ ได้ไต่ถาม ความต้องการของอัยการ (ซึ่งในสหรัฐ อัยการสูงสุดสหรัฐฯ เป็นฝ่ายการเมือง ต่างจากอัยการสูงสุดในไทย ที่เป็นข้าราชการประจำ) และเจ้าหน้าที่ F.B.I. ว่า มีความต้องการให้รัฐสภา ออกกฎหมายใดเป็นการเพิ่มเติม เพื่อส่งเสริมให้เกิดประสิทธิภาพสูงสุดในการดำเนินการหรือไม่ มีอุปสรรคใด ในการดำเนินการตามกฎหมายหรือไม่ ฯลฯ
กระบวนการออกกฎหมายของสหรัฐฯ นี้ นับว่าแตกต่างจากประเทศไทยอย่างมาก เพราะรัฐสภาของไทย โดยคณะกรรมาธิการคณะต่าง ๆ ซึ่งผมไม่แน่ใจว่าปัจจุบัน มีจำนวนเท่าใด (น่าจะเกือบ ๓๐ คณะ) แทบจะไม่เคยแสดงบทบาทใด ๆ ในการบัญญัติกฎหมาย เพื่อส่งเสริมให้หน่วยงานฝ่ายบริหาร ซึ่งเป็นฝ่ายบังคับใช้กฎหมาย ได้ปฏิบัติงานได้อย่างมีประสิทธิภาพเลย ประเทศไทย จะรอให้หน่วยงานต่าง ๆ เช่น สำนักงานตำรวจแห่งชาติ ฯลฯ เสนอกฎหมายเข้าไปยังคณะรัฐมนตรีเพื่อพิจารณา จากนั้น คณะรัฐมนตรี อาจจะส่งให้สำนักงานคณะกรรมการกฤษฎีกา ไปพิจารณาร่างกฎหมายที่เสนอมา หลังจากตัวแทนจากหน่วยงานที่เสนอกฎหมาย ก็ไปชี้แจงต่อสำนักงานคณะกรรมการกฤษฎีกา ว่ากฎหมายมีความจำเป็นอย่างไร ฯลฯ กว่าจะผ่านออกมาได้ ก็ใช้เวลาค่อนข้างนานมาก ๆ บางทีหมดวาระไปก่อน หากรัฐบาลใหม่เข้ามา แล้วไม่เล่นด้วยละก็ ผลก็คือ ร่างกฎหมายเก่านั้นก็ตกไป แม้จะผ่านการรับรองของสภาผู้แทนราษฎรแล้ว แต่ยังไม่ครบถ้วนกระบวนความตามที่รัฐธรรมนูญกำหนด
ตรงกันข้ามกับรัฐสภา หรือ หน่วยงานระดับมลรัฐ ของสหรัฐฯ มาก สภา congress หรือ สภาของมลรัฐ จะมีหน่วยงานผู้ชำนาญการในการร่างกฎหมาย และตอบสนองความต้องการของหน่วยงานบังคับใช้กฎหมายอย่างรวดเร็ว ไม่ต้องรอให้หน่วยงานใด เสนอมาแบบไทย ๆ ซึ่งหน่วยงานราชการไทย ส่วนใหญ่เอง ก็ไม่ได้ให้ความสำคัญกับนักกฎหมายเท่าไหร่ เพราะเป็นงานที่ไม่มีหน้าไม่มีตา เช่นหน่วยงานตำรวจ งานกฎหมาย เสมือนงานปิดทองหลังพระ ไม่สร้างภาพลักษณ์ที่โดดเด่นแบบงานป้องกันปราบปราม งานสืบสวน จับกุมร้าย นายตำรวจใหญ่บางท่าน ถึงกับขนาดกล่าวว่า ไม่ต้องสนใจงานหนังสือ หรืองานกฎหมาย ใส่ใจงานจับผู้ร้าย รายสำคัญ ๆ ก็พอ ....
ผมเห็นแตกต่างอย่างมาก เพราะ หากจับได้ แต่ไม่ได้ดำเนินการตามกฎหมาย หลักฐานไม่เพียงพอที่จะลงโทษผู้ร้ายได้แล้ว การลงทุน ติดตามจับกุมผู้ร้าย ซึ่งต้องใช้เงินจำนวนมาก แต่รัฐบาลไทยในอดีตไม่เคยตั้งงบประมาณแผ่นดินให้ตำรวจไปติดตามจับกุมผู้ร้าย ที่อาจจะหลบหนี ไปต่างจังหวัด ซ่อนตัว อยู่ตามที่ต่าง ๆ แรมเดือน แรมปี ... ตำรวจที่มุ่งมั่น ก็อาจจะลงทุน ใช้เงินส่วนตัว ติดตามจนสามารถจับกุมผู้ร้ายนั้นได้ แต่การลงทุนนั้น จะสูญเปล่าทันที หากสุดท้าย ไม่มีพยานหลักฐานในการลงโทษจำเลยนั้น
ผมฝันของผมว่า อยากเห็นรัฐสภาไทย มีคุณภาพ มีความกระตือรือร้นในการออกกฎหมายดี ๆ เพื่อบ้านเมือง กฎหมายบางเรื่อง เช่น ภาษีมรดก หรือ ภาษีบ้านเรือนของคนรวย ๆ ที่มีเนื้อที่ดินเยอะ ๆ เช่นว่า ใครมีที่ดินเยอะ ก็ควรจะเสียภาษีเยอะ โดยเฉพาะคนที่มีที่ดิน เพื่อเก็งกำไร ไม่ได้ทำประโยชน์ให้เกิดความงอกงามทางเศรษฐกิจใด ๆ ก็ควรจะเสียภาษีเยอะ คณะกรรมาธิการ สมาชิกรัฐสภา และหน่วยงานของรัฐที่เกี่ยวข้องของไทย ก็ควรเร่งดำเนินการให้เป็นจริงเป็นจังให้ได้ ไม่อยากเห็นการตั้งคณะกรรมาธิการต่าง ๆ ของรัฐสภาไทย ทำเพื่อเป็นเกียรติ หรือ จับผิดฝ่ายบริหารเท่านั้น
ขอย้อนกลับมาเรื่องที่สอง ตามหัวเรื่อง คือเรื่อง Cyberspace crime หรือ อาชญากรรมที่เกิดขึ้นในโลกของอินเตอร์เน็ต หากจะพูดกันจริง ๆ แล้ว กฎหมายที่ครอบคลุมในประเด็นนี้ ในสหรัฐเอง ก็เพิ่งจะมีการศึกษาอย่างจริงจัง ในช่วงปี ค.ศ.๑๙๙๐ ที่ผ่านมานี่เอง และหลายเรื่อง ก็ยังไม่มีคำพิพากษาตัดสินไว้เป็นคดีบรรทัดฐาน และไม่มีการบัญญัติกฎหมายไว้อย่างเป็นลายลักษณ์อักษรด้วย หากคดีประเภทนี้เกิดขึ้นในสหรัฐฯ ก็คงจะต้องสู้กันมันส์หยดแน่ ๆ ระหว่างผู้ถูกฟ้องกับผู้ฟ้องคดี
ตัวอย่างของการกระทำบนโลกอินเตอร์เน็ต เช่น สมมุติว่าเราเล่นเกมส์ออนไลน์ เราเล่นเก่ง สามารถสะสมอาวุธได้อย่างมากมาย ในขณะที่คนอื่นเล่นไม่เก่ง แต่อยากได้อาวุธจากเรา อาวุธ ในเกมส์ออนไลน์ ก็เป็นเพียงข้อมูลที่มีการบันทึกโดยระบบคอมพิวเตอร์ ปัญหาคือ วันดีคืนดี มีมือดี เก่งกาจทางคอมพิวเตอร์ เข้ามาขโมยอาวุธของเราไป โดยไม่ยอมซื้อหาจากเราโดยดี การกระทำดังกล่าวจะมีผิดทางอาญาหรือไม่ หรือ อย่างน้อย เราจะเรียกร้องในทางแพ่งได้หรือไม่ อันนี้ คือ ปัญหาที่น่าสนใจสำหรับสังคมของเรา ที่นับวันอินเตอร์เน็ตจะเข้ามามีบทบาทต่อชีวิตของเรามากขึ้นทุกวัน
เรื่องในทำนองที่กล่าวมาข้างต้นนี้ เคยเกิดขึ้นในประเทศจีน ตั้งแต่ปี ค.ศ. ๒๐๐๕ นาย Qui Chengwei ได้จ้วงแทงนาย Zhu Caoyuan ที่หน้าอก เพราะนาย Zhu ได้ขอยืมอาวุธเสมือนจริงที่เล่นได้จากเกมส์ออนไลน์ จากนาย Qui โดยอ้างว่า จะนำไปใช้ในการต่อสู้ในเกมส์นั้น แต่ปรากฎว่า นาย Zhu ได้แอบเอาอาวุธนั้นไปขาย ได้เงินมาถึง ๗,๐๐๐ หยวน หรือ ประมาณ ๔๗๓ ปอนด์ โดยไม่ได้รับอนุญาตจากนาย Qui แถมยังไม่ยอมแบ่งให้นาย Qui อีกด้วย (มันน่าเจ็บใจไหมละครับ)
เมื่อนาย Qui ล่วงรู้ จึงได้ไปแจ้งความกับตำรวจในข้อหา "ยักยอก" โดยนาย Zhu ได้ครอบครองข้อมูลที่เสมือนเป็นอาวุธดาบ (virtual sword) ของตน แล้วเบียดบังเป็นของตนเอง พร้อมนำไปขาย โดยที่ไม่ได้รับอนุมัติจากนาย Qui เลย ตำรวจจีน ท่านไม่รับแจ้งความ โดยบอกว่า ยังไม่มีกฎหมายกำหนดให้การกระทำดังกล่าวของนาย Zhu เป็นความผิดทางอาญา เป็นเหตุให้นาย Qui เดือดดาลเป็นยิ่งนัก โดยเฉพาะอย่างยิ่ง เมื่อนาย Zhu ที่แต่แรกเริ่มเดิมที ยังทำเป็นไม่รู้ไม่ชี้ ทำตัวเป็นทองไม่รู้ร้อนด้วยแล้ว นาย Qui จึงเลิกพูดถึงดาบเสมือนจริง (virtual sword) ที่ตนเอง นั่งหลังขดหลังแข็งต่อสู้จนได้มาอีกต่อไปแล้ว แต่นาย Qui คิดถึงแต่ดาบจริง ๆ แล้วเขาก็เอาดาบจริง ๆ ฝากไว้บนอกของนาย Zhu เข้าให้ ปัจจุบัน นาย Qui จึงถูกตัดสินให้รับโทษประหารชีวิตเพราะการฆ่าผู้อื่นโดยเจตนา แต่ให้ชะลอการประหารชีวิตไปก่อน (หากท่านผู้ใดสนใจจะอ่านรายละเอียดโปรด คลิ๊กที่นี่ ได้เลยครับ)
ในทางตรงกันข้าม เรื่องทำนองนี้ หากเกิดขึ้นในเกาหลีใต้แล้ว ย่อมไม่รอดเป็นแน่แท้ ตำรวจเกาหลี ได้ตั้งหน่วยสืบสวนสอบสวนคดีทาง Technology ลักษณะนี้โดยตรง มาหลายปีแล้ว เช่น ในปี ค.ศ. ๒๐๐๓ มีการรายงานคดีเกี่ยวกับการกระทำผิดในโลกของอินเตอร์เน็ตนี้ ประมาณ ๔๐,๐๐๐ คดี ในรอบ ๖ เดือน โดยครึ่งหนึ่ง เป็นคดีที่เกิดขึ้นและเกี่ยวกับเกมส์ออนไลน์ เนื่องจากเกาหลีใต้ตระหนักว่า การซื้อขายสิ่งของต่าง ๆ บนอินเตอร์เน็ต มีเพิ่มขึ้นเรื่อย ๆ นั่นเอง โดยเปรียบเทียบกับเงินในบัญชีของเราที่ฝากธนาคารไว้ แท้จริง ก็คือ ข้อมูลที่บันทึกไว้เท่านั้น หาใช่ตัวเงินจริง ๆ ที่ธนาคารได้รวบรวมไว้เสียที่ไหนเล่า ด้วยเหตุนี้ ข้อมูลบนเกมส์ออนไลน์ ก็ควรได้รับการคุ้มครองด้วย (หากผู้ใดสนใจ โปรด คลิ๊กที่นี่ ได้เลยครับ)
หากเราจะพิจารณาปัญหาในเรื่องนี้ คงจะต้องมองกลับไปถึงปัญหาพื้นฐานในทางกฎหมาย ที่จะต้องพิจารณาก่อนว่าข้อมูลเหล่านี้ เป็นทรัพย์ หรือเป็นเพียงแค่ข้อมูลในโลกไซเบอร์ ที่ไม่ใช่ "ทรัพย์" ตามกฎหมาย หากเป็น "ทรัพย์" ตามนิยามกฎหมายแล้ว ก็จะได้รับการคุ้มครองตามกฎหมายอาญา หากมีผู้ใดมาล่วงละเมิดสิทธิของเจ้าของทรัพย์นั้น แต่หากมองเป็นเพียงข้อมูลที่บันทึกในโปรแกรมคอมพิวเตอร์แล้ว ก็จะไม่ได้รับการคุ้มครองตามกฎหมายอาญา
ในทางกฎหมายนั้น "ทรัพย์" จะต้องมีรูปร่าง จับต้อง และถือเอาได้ อาวุธเสมือนจริง (Virtual sword) นั้น ไม่อาจจับต้องได้ ไม่มีรูปร่าง จึงไม่เข้านิยามของคำว่า "ทรัพย์" ที่ได้กล่าวไปแล้ว ครั้นจะเหลียวมองไปยังกฎหมายอื่น ๆ โดยเฉพาะกฎหมายที่เกี่ยวกับทรัพย์สินทางปัญญา ซึ่งจะครอบคลุมเรื่องลิขสิทธิ์ สิทธิบัตร และเครื่องหมายการค้าเท่านั้น ด้วยเหตุนี้ ข้อมูลที่เป็นอาวุธเสมือนจริง (Virtual sword) หรือ ทรัพย์สินเสมือนจริงในโลกไซเบอร์ ก็ไม่อยู่ขอบข่ายกฎหมายดังกล่าวอีก จึงไม่ได้รับการคุ้มครองใด ๆ ตามกฎหมายอาญา
ไม่ทราบว่าเมืองไทยเรา ได้คิดไปถึงไหนแล้ว โดยเฉพาะองค์กร อย่างเนคเทค ที่มีหน้าที่โดยตรงในการเสนอกฎหมายนี้ ได้เสนอกฎหมายที่ครอบคลุมประเด็นดังกล่าวไปครบถ้วนหรือไม่ เพราะไม่อยากให้ประชาชนรู้สึกว่า พึ่งพากฎหมายไม่ได้ แล้วหันไปช่วยตัวเอง โดยใช้หลักตาต่อตา ฟันต่อฟัน ดีกว่า ....

บุช สร้างประวัติศาสตร์ ประธานศาลสูงที่อายุน้อยที่สุดในรอบ ๒๐๐ ปีของสหรัฐฯ
ผมเชื่อว่า เรื่องนี้คนทั่วไป แม้กระทั่งในสหรัฐอเมริกาฯ คงไม่ค่อยสนใจสักเท่าไหร่ เพราะคิดว่ามันไกลตัว ใครจะเป็นผู้พิพากษา หรือ ใครจะมาเป็นประธานศาลสูงสุด ก็ออกจะไม่เกี่ยวกับเรื่องของ "ลูกชายปู่" ของเขาสักเท่าไหร่ แต่อาจจะมีนักกฎหมายด้วยกันที่สนใจ โดยเฉพาะนักกฎหมายในสหรัฐอเมริกา
ประธานธิบดีบุชฯ ได้ทำให้ท่านโรเบิร์ต เป็นประวัติศาสตร์แห่งวงการกฎหมายสหรัฐฯไปแล้ว เพราะเขาเป็นประธานศาลสูงสุดของสหรัฐฯ ที่หนุ่มที่สุดในรอบ ๒๐๐ ปี ท่านประธานคนใหม่นี้ ตอนหนุ่ม ๆ เคยเป็นเลขาประธานศาลคนก่อนที่ล่วงลับไปไม่นาน และเป็นพวกอนุรักษ์นิยมเหมือนกัน อีกทั้งยังเคยทำงานให้อดีตประธานาธิบดี เรแกน ซึ่งมีอดีต บุชฯ ผู้พ่อ เป็นรองประธานาธิบดีฯ ปัจจุบัน นายโรเบิร์ต เพิ่งอายุ ๕๐ ปีเท่านั้น การปฏิบัติงานของเขาจะสร้างผลกระทบต่อพลเมืองสหรัฐฯ ไปตลอดการดำรงตำแหน่งของเขา ซึ่งผมคิดว่า ถ้าเขาไม่เกษียณตัวเอง หรือมีอันเป็นไปเสียก่อน เขาคงจะอยู่อีกอย่างน้อย ๓๐ ปี กระมัง
หากจะกล่าวไปจริง ๆ ประธานาธิบดีบุชฯ แต่งตั้งคนข้ามหัว ผู้พิพากษาอาวุโส ที่อยู่ในศาลสูงสุดปัจจุบัน ซึ่งยังมีชีวิตและปฏิบัติหน้าที่อยู่ จำนวน ๗ คน ถ้าพิจารณาจากบริบทของไทยแล้ว ก็ดูจะเป็นการไม่เหมาะสมเท่าไหร่ เพราะคนที่ทำงานในศาลสูงสุดมาก่อน ย่อมมีความรู้ และประสบการณ์ที่เหนือกว่านายโรเบิร์ตฯ เป็นแน่ (ถ้าเกิดเหตุการณ์นี้ในไทย ศาลคงแตกละเอียด) แต่ที่สหรัฐอเมริกานี้ ยอมรับระบบว่า ประธานาธิบดี มีอำนาจเต็มในการเสนอแต่งตั้งเจ้าหน้าที่ระดับสูงของสหรัฐฯ ซึ่งเป็นไปตามรัฐธรรมนูญของสหรัฐฯ ซึ่งรัฐสภา จะไม่อาจออกกฎหมายให้มีคณะกรรมการสรรหาผู้มาดำรงตำแหน่ง อย่างไทยได้ (เพราะรัฐธรรมนูญไทยกำหนดไว้แตกต่างกับรัฐธรรมนูญสหรัฐฯ) แต่การเสนอชื่อของประธานาธิบดี จะต้องได้รับการยอมรับจากวุฒิสภาฯ หากเสียงข้างมากยอมรับ ก็เป็นอันใช้ได้
อย่างไรก็ตาม ก่อนที่จะมีการลงมติ ทางวุฒิสภา จะตั้งกรรมการขึ้นมาตรวจสอบคุณสมบัติฯ ของนายโรเบิร์ต โดยมีการซักถาม สืบสวนสอบสวน เป็นเวลานานพอสมควร มีการถ่ายทอดสดทางโทรทัศน์ และสื่อมวลชนก็ติดตาม การตอบคำถามโดยคณะกรรมการยุติธรรมของวุฒิสภาฯ ดังกล่าวโดยตลอด เมื่อสิ้นสุดกระบวนการตรวจสอบ ก็จะมีการมติโดยวุฒิสภาฯ ว่าจะรับรองการเสนอชื่อดังกล่าวหรือไม่
ในการลงมติครั้งนี้ วุฒิสภาฯ พรรคเดโมแครต ประมาณครึ่งหนึ่ง กังวลว่า นายโรเบิร์ต จะกลับคำพิพากษาในคดี Roe v. Wade ที่มีการวางหลักการไว้ตั้งแต่ ในปี ค.ศ. ๑๙๗๓ ว่า สิทธิในการทำแท้งเป็นสิทธิในความเป็นส่วนตัว (right of privacy) ซึ่งสิทธิขั้นพื้นฐาน (fundamental rights) ที่รัฐไม่อาจจะแทรกแซงได้ หากมีการกำหนดอะไรเป็นพิเศษ เช่น ห้ามทำแท้งฯ ก็จะขัดรัฐธรรมนูญของสหรัฐฯ ด้วยเหตุที่นายโรเบิร์ต ได้แสดงความไม่เห็นด้วยไว้อย่างกว้างขวาง ตั้งแต่สมัยหนุ่มที่เป็นที่ปรึกษาของประธานาธิบดีเรแกน จากพรรค Republican เช่นเดียวกับประธานาธิบดีบุช ฯ แต่นายโรเบิร์ต ก็ได้แถลงการณ์ยอมรับแล้วว่า คำพิพากษาดังกล่าวเป็นบรรทัดฐานมาเนิ่นนานกว่า ๓๐ ปีแล้ว ซึ่งแสดงเป็นนัยว่า คงไม่มีการเปลี่ยนแปลงฯ ใด ๆ อีก
ในเมืองไทย เคยมีปัญหาวินิจฉัยเรื่องสิทธิในการทำแท้งของหญิงเหมือนกัน ตามประมวลกฎหมายอาญา สิทธิในการทำแท้งของหญิงมีค่อนข้างจำกัดฯ เฉพาะกรณีที่หญิงถูกข่มขืน หรือ ตั้งครรภ์ต่อไป จะเป็นอันตรายต่อหญิงฯ เอง บางกรณีที่ เด็กเกิดมาจะมีปัญหา เช่น เป็นหัดเยอรมันฯ หรือ ติดเชื้อร้ายแรงฯ ปัญญาอ่อนร้ายแรง ฯลฯ กรณีนี้ คณะกรรมการกฤษฎีกา เคยวินิจฉัยว่า หญิงไม่อาจทำแท้งได้ เพราะไม่เข้าข้อยกเว้นในการห้ามทำแท้งตามหลักกฎหมาย สองประการข้างต้น
แล้วแต่นะครับ ... อาจารย์ผม เขาพูดเล่น ๆ เหมือนกันว่า สิทธิในการทำแท้ง กรณีนี้ น่าจะตีความขยายอันตรายต่อหญิง น่าจะรวม อันตรายต่อจิตใจ เพราะหากลูกเกิดมาพิกลพิการ เจ็บไข้ร้ายแรงฯ ไม่มีทางรอดแน่ ๆ การให้เกิดมาก็ดูเหมือนจะทำร้ายจิตใจแม่จนเกินไป เพราะลูกอาจจะอยู่ได้ไม่ได้นาน หลังจากทรมานแสนสาหัสฯ
อาจารย์ ท่านยังพูดเล่น ๆ อีกประการหนึ่งว่า คนที่วินิจฉัยเรื่องที่ห้ามทำแท้งกรณีนี้ ก็ไม่ได้เป็นคนที่ต้องทุกข์ หรือ ต้องมารับเลี้ยงดูด้วยแต่ประการใด อิ อิ ....จริงของอาจารย์เขาแฮะ

Roberts is the youngest Chief Justice in 200 years of the U.S. Supreme Court record; he presently is 50 years old. He will work as chief Justice as long as he is able to work in this highest honorable position of judge career.

His walk of life is very impressive to me; he used to be the secretary of the late chief justice when he was young. He became the federal judge and appointed as the Chief Justice of the U.S. Supreme Court at the youngest age in history. His performance will appreciably effect to all persons in the U.S. for at least 30 years in the future.
Under the U.S. Constitution, the president shall exercise the absolute power to appoint the high level of the U.S. officers but subjected to the approval of the US Senate. Chief Just Robert, for example, was affirmed by the U.S. Senate at a margin of 78-22; of which all of Republican senetors approved him.
Around a half of Democrat Party did reject him as the new chief justice because they felt insecure of Robert's position of some area of law, especailly, the right of privacy of the woman's right to make decision whether they can legally terminate their pregnancy. Robert disagreed with the establishment of right to privacy of woman as the fundamental right in this area.

In Roe v. Wade case, 1973 : the U.S. Supreme Court held that state laws that prohibit abortions except to save the life of the mother were unconstitutional because they violated a right to privacy protected by the Fourteenth Amendment's Due Process Clause. The Court ruled that it was the right of privacy which is broad enough to encompass a woman's decision whether or not to terminate her pregnancy.
Chief Justice Robert said last two weeks that Roe is the precedent rule of law which has been set up for at least 30 years. It implies that he would not change the rule of law in the privacy rights area.
Nine Supreme Court Judges
The next question are far more vital; for examples, whether Robert will be able to work impartially without any saction of the Executive power under Bush Administration! Whether there will be problems of conflict between the rest of supreme court judges and the new comer! How will the newest chief justice handle the rule of law in the future?
Here are the ten landmark cases of the U.S.Supreme Court decision that Msnbc news has concluded:
1. Dred scott v. Sanford, 1857: In an opinion by Chief Justice Roger Taney, the court held that blacks could not become citizens of the United States and that slave owners had the right to take their slaves into U.S. territories. The decision added to the North-South animosity that led to the Civil War.
2. Yick Wo v. Hopkins, 1886: In a case involving a Chinese laundry owner in San Francisco, the court ruled that the Equal Protection Clause of the Fourteenth Amendment "is not confined to the protection of citizens," but instead its protections "are universal in their application, to all persons within the territorial jurisdiction, without regard to any differences of race, of color, or of nationality.." This provided a basis for Supreme Court rulings in the 1970s and 1980s that states had to provide education and other benefits to illegal aliens.
3. Pollock v. Farmer's Loan and Trust Co. II.,1895: Responding to declining tariff revenues and Populist pressure for taxing the wealthy, Congress imposed a two- percent income tax in 1894. The court ruled the tax unconstitutional, leading to a popular backlash and ratification of the 16th amendment to the Constitution, which authorized an income tax.
4. Plessy v. Furguson, 1896: The court upheld a Louisiana law requiring racial segregation on trains. The justices said the Equal Protection Clause of the Fourteenth Amendment "could not have been intended to abolish distinctions based upon color" or to enforce "a commingling of the two races unsatisfactory to either."
5. West Coast Hotel v. Parrish, 1937: After years of ruling against government regulation of wages and working conditions, the court, led by Chief Justice Charles Evans Hughes, reversed itself and sustained Washington state's minimum wage law. Coming in the middle of congressional debate over President Roosevelt's "court-packing" proposal to add pro-regulation justices to the high court, the decision helped undermine support for the plan.
6. U.S. v. Carolene Products, 1938: In the famous "footnote four," Chief Justice Harlan Fiske Stone began a constitutional revolution by declaring that the court would apply a minimal "rational basis" test to review economic regulations, but would apply a "more exacting judicial scrutiny" to laws which impinged on freedoms protected by the Bill of Rights, or which targeted religious or ethnic minorities. This ultimately led to the court using a "strict scrutiny" test to strike down such state laws as English literacy requirements for voting.
7. Brown v. Board of Education, 1954: The court discarded the "separate but equal" doctrine of Plessy v. Ferguson and declared that racial segregation in public schools violated the Equal Protection Clause of the Fourteenth Amendment.
8. Roe v. Wade, 1973: The court held that state laws that prohibit abortions except to save the life of the mother were unconstitutional because they violated a right to privacy protected by the Fourteenth Amendment's Due Process Clause. "This right of privacy.is broad enough to encompass a woman's decision whether or not to terminate her pregnancy," declared Justice Harry Blackmun, writing for the majority.
9.Grutter v. Bollinger, 2003: The court upheld the University of Michigan's use of racial and ethnic preferences to increase the numbers of black, Latino and Native American applicants admitted to its law school. Justice Sandra Day O'Connor, writing for the majority, held that "race-conscious admissions policies must be limited in time" and predicted that "25 years from now, the use of racial preferences will no longer be necessary."
10. Lawrence v. Texas, 2003: The court struck down state anti-sodomy laws, deeming them a violation of the Due Process Clause of the Fourteenth Amendment. The majority opinion by Justice Anthony Kennedy said decisions relating to marriage, procreation, and child rearing are constitutionally protected and "persons in a homosexual relationship may seek autonomy for these purposes, just as heterosexual persons do."
