บุช สร้างประวัติศาสตร์ ประธานศาลสูงที่อายุน้อยที่สุดในรอบ ๒๐๐ ปีของสหรัฐฯ
ผมเชื่อว่า เรื่องนี้คนทั่วไป แม้กระทั่งในสหรัฐอเมริกาฯ คงไม่ค่อยสนใจสักเท่าไหร่ เพราะคิดว่ามันไกลตัว ใครจะเป็นผู้พิพากษา หรือ ใครจะมาเป็นประธานศาลสูงสุด ก็ออกจะไม่เกี่ยวกับเรื่องของ "ลูกชายปู่" ของเขาสักเท่าไหร่ แต่อาจจะมีนักกฎหมายด้วยกันที่สนใจ โดยเฉพาะนักกฎหมายในสหรัฐอเมริกา
ประธานธิบดีบุชฯ ได้ทำให้ท่านโรเบิร์ต เป็นประวัติศาสตร์แห่งวงการกฎหมายสหรัฐฯไปแล้ว เพราะเขาเป็นประธานศาลสูงสุดของสหรัฐฯ ที่หนุ่มที่สุดในรอบ ๒๐๐ ปี ท่านประธานคนใหม่นี้ ตอนหนุ่ม ๆ เคยเป็นเลขาประธานศาลคนก่อนที่ล่วงลับไปไม่นาน และเป็นพวกอนุรักษ์นิยมเหมือนกัน อีกทั้งยังเคยทำงานให้อดีตประธานาธิบดี เรแกน ซึ่งมีอดีต บุชฯ ผู้พ่อ เป็นรองประธานาธิบดีฯ ปัจจุบัน นายโรเบิร์ต เพิ่งอายุ ๕๐ ปีเท่านั้น การปฏิบัติงานของเขาจะสร้างผลกระทบต่อพลเมืองสหรัฐฯ ไปตลอดการดำรงตำแหน่งของเขา ซึ่งผมคิดว่า ถ้าเขาไม่เกษียณตัวเอง หรือมีอันเป็นไปเสียก่อน เขาคงจะอยู่อีกอย่างน้อย ๓๐ ปี กระมัง
หากจะกล่าวไปจริง ๆ ประธานาธิบดีบุชฯ แต่งตั้งคนข้ามหัว ผู้พิพากษาอาวุโส ที่อยู่ในศาลสูงสุดปัจจุบัน ซึ่งยังมีชีวิตและปฏิบัติหน้าที่อยู่ จำนวน ๗ คน ถ้าพิจารณาจากบริบทของไทยแล้ว ก็ดูจะเป็นการไม่เหมาะสมเท่าไหร่ เพราะคนที่ทำงานในศาลสูงสุดมาก่อน ย่อมมีความรู้ และประสบการณ์ที่เหนือกว่านายโรเบิร์ตฯ เป็นแน่ (ถ้าเกิดเหตุการณ์นี้ในไทย ศาลคงแตกละเอียด) แต่ที่สหรัฐอเมริกานี้ ยอมรับระบบว่า ประธานาธิบดี มีอำนาจเต็มในการเสนอแต่งตั้งเจ้าหน้าที่ระดับสูงของสหรัฐฯ ซึ่งเป็นไปตามรัฐธรรมนูญของสหรัฐฯ ซึ่งรัฐสภา จะไม่อาจออกกฎหมายให้มีคณะกรรมการสรรหาผู้มาดำรงตำแหน่ง อย่างไทยได้ (เพราะรัฐธรรมนูญไทยกำหนดไว้แตกต่างกับรัฐธรรมนูญสหรัฐฯ) แต่การเสนอชื่อของประธานาธิบดี จะต้องได้รับการยอมรับจากวุฒิสภาฯ หากเสียงข้างมากยอมรับ ก็เป็นอันใช้ได้
อย่างไรก็ตาม ก่อนที่จะมีการลงมติ ทางวุฒิสภา จะตั้งกรรมการขึ้นมาตรวจสอบคุณสมบัติฯ ของนายโรเบิร์ต โดยมีการซักถาม สืบสวนสอบสวน เป็นเวลานานพอสมควร มีการถ่ายทอดสดทางโทรทัศน์ และสื่อมวลชนก็ติดตาม การตอบคำถามโดยคณะกรรมการยุติธรรมของวุฒิสภาฯ ดังกล่าวโดยตลอด เมื่อสิ้นสุดกระบวนการตรวจสอบ ก็จะมีการมติโดยวุฒิสภาฯ ว่าจะรับรองการเสนอชื่อดังกล่าวหรือไม่
ในการลงมติครั้งนี้ วุฒิสภาฯ พรรคเดโมแครต ประมาณครึ่งหนึ่ง กังวลว่า นายโรเบิร์ต จะกลับคำพิพากษาในคดี Roe v. Wade ที่มีการวางหลักการไว้ตั้งแต่ ในปี ค.ศ. ๑๙๗๓ ว่า สิทธิในการทำแท้งเป็นสิทธิในความเป็นส่วนตัว (right of privacy) ซึ่งสิทธิขั้นพื้นฐาน (fundamental rights) ที่รัฐไม่อาจจะแทรกแซงได้ หากมีการกำหนดอะไรเป็นพิเศษ เช่น ห้ามทำแท้งฯ ก็จะขัดรัฐธรรมนูญของสหรัฐฯ ด้วยเหตุที่นายโรเบิร์ต ได้แสดงความไม่เห็นด้วยไว้อย่างกว้างขวาง ตั้งแต่สมัยหนุ่มที่เป็นที่ปรึกษาของประธานาธิบดีเรแกน จากพรรค Republican เช่นเดียวกับประธานาธิบดีบุช ฯ แต่นายโรเบิร์ต ก็ได้แถลงการณ์ยอมรับแล้วว่า คำพิพากษาดังกล่าวเป็นบรรทัดฐานมาเนิ่นนานกว่า ๓๐ ปีแล้ว ซึ่งแสดงเป็นนัยว่า คงไม่มีการเปลี่ยนแปลงฯ ใด ๆ อีก
ในเมืองไทย เคยมีปัญหาวินิจฉัยเรื่องสิทธิในการทำแท้งของหญิงเหมือนกัน ตามประมวลกฎหมายอาญา สิทธิในการทำแท้งของหญิงมีค่อนข้างจำกัดฯ เฉพาะกรณีที่หญิงถูกข่มขืน หรือ ตั้งครรภ์ต่อไป จะเป็นอันตรายต่อหญิงฯ เอง บางกรณีที่ เด็กเกิดมาจะมีปัญหา เช่น เป็นหัดเยอรมันฯ หรือ ติดเชื้อร้ายแรงฯ ปัญญาอ่อนร้ายแรง ฯลฯ กรณีนี้ คณะกรรมการกฤษฎีกา เคยวินิจฉัยว่า หญิงไม่อาจทำแท้งได้ เพราะไม่เข้าข้อยกเว้นในการห้ามทำแท้งตามหลักกฎหมาย สองประการข้างต้น
แล้วแต่นะครับ ... อาจารย์ผม เขาพูดเล่น ๆ เหมือนกันว่า สิทธิในการทำแท้ง กรณีนี้ น่าจะตีความขยายอันตรายต่อหญิง น่าจะรวม อันตรายต่อจิตใจ เพราะหากลูกเกิดมาพิกลพิการ เจ็บไข้ร้ายแรงฯ ไม่มีทางรอดแน่ ๆ การให้เกิดมาก็ดูเหมือนจะทำร้ายจิตใจแม่จนเกินไป เพราะลูกอาจจะอยู่ได้ไม่ได้นาน หลังจากทรมานแสนสาหัสฯ
อาจารย์ ท่านยังพูดเล่น ๆ อีกประการหนึ่งว่า คนที่วินิจฉัยเรื่องที่ห้ามทำแท้งกรณีนี้ ก็ไม่ได้เป็นคนที่ต้องทุกข์ หรือ ต้องมารับเลี้ยงดูด้วยแต่ประการใด อิ อิ ....จริงของอาจารย์เขาแฮะ

The U.S. Supreme Court
Roberts is the youngest Chief Justice in 200 years of the U.S. Supreme Court record; he presently is 50 years old. He will work as chief Justice as long as he is able to work in this highest honorable position of judge career.

His walk of life is very impressive to me; he used to be the secretary of the late chief justice when he was young. He became the federal judge and appointed as the Chief Justice of the U.S. Supreme Court at the youngest age in history. His performance will appreciably effect to all persons in the U.S. for at least 30 years in the future.
Under the U.S. Constitution, the president shall exercise the absolute power to appoint the high level of the U.S. officers but subjected to the approval of the US Senate. Chief Just Robert, for example, was affirmed by the U.S. Senate at a margin of 78-22; of which all of Republican senetors approved him.
Around a half of Democrat Party did reject him as the new chief justice because they felt insecure of Robert's position of some area of law, especailly, the right of privacy of the woman's right to make decision whether they can legally terminate their pregnancy. Robert disagreed with the establishment of right to privacy of woman as the fundamental right in this area.

In Roe v. Wade case, 1973 : the U.S. Supreme Court held that state laws that prohibit abortions except to save the life of the mother were unconstitutional because they violated a right to privacy protected by the Fourteenth Amendment's Due Process Clause. The Court ruled that it was the right of privacy which is broad enough to encompass a woman's decision whether or not to terminate her pregnancy.
Chief Justice Robert said last two weeks that Roe is the precedent rule of law which has been set up for at least 30 years. It implies that he would not change the rule of law in the privacy rights area.
Nine Supreme Court Judges
The next question are far more vital; for examples, whether Robert will be able to work impartially without any saction of the Executive power under Bush Administration! Whether there will be problems of conflict between the rest of supreme court judges and the new comer! How will the newest chief justice handle the rule of law in the future?
Here are the ten landmark cases of the U.S.Supreme Court decision that Msnbc news has concluded:
1. Dred scott v. Sanford, 1857: In an opinion by Chief Justice Roger Taney, the court held that blacks could not become citizens of the United States and that slave owners had the right to take their slaves into U.S. territories. The decision added to the North-South animosity that led to the Civil War.
2. Yick Wo v. Hopkins, 1886: In a case involving a Chinese laundry owner in San Francisco, the court ruled that the Equal Protection Clause of the Fourteenth Amendment "is not confined to the protection of citizens," but instead its protections "are universal in their application, to all persons within the territorial jurisdiction, without regard to any differences of race, of color, or of nationality.." This provided a basis for Supreme Court rulings in the 1970s and 1980s that states had to provide education and other benefits to illegal aliens.
3. Pollock v. Farmer's Loan and Trust Co. II.,1895: Responding to declining tariff revenues and Populist pressure for taxing the wealthy, Congress imposed a two- percent income tax in 1894. The court ruled the tax unconstitutional, leading to a popular backlash and ratification of the 16th amendment to the Constitution, which authorized an income tax.
4. Plessy v. Furguson, 1896: The court upheld a Louisiana law requiring racial segregation on trains. The justices said the Equal Protection Clause of the Fourteenth Amendment "could not have been intended to abolish distinctions based upon color" or to enforce "a commingling of the two races unsatisfactory to either."
5. West Coast Hotel v. Parrish, 1937: After years of ruling against government regulation of wages and working conditions, the court, led by Chief Justice Charles Evans Hughes, reversed itself and sustained Washington state's minimum wage law. Coming in the middle of congressional debate over President Roosevelt's "court-packing" proposal to add pro-regulation justices to the high court, the decision helped undermine support for the plan.
6. U.S. v. Carolene Products, 1938: In the famous "footnote four," Chief Justice Harlan Fiske Stone began a constitutional revolution by declaring that the court would apply a minimal "rational basis" test to review economic regulations, but would apply a "more exacting judicial scrutiny" to laws which impinged on freedoms protected by the Bill of Rights, or which targeted religious or ethnic minorities. This ultimately led to the court using a "strict scrutiny" test to strike down such state laws as English literacy requirements for voting.
7. Brown v. Board of Education, 1954: The court discarded the "separate but equal" doctrine of Plessy v. Ferguson and declared that racial segregation in public schools violated the Equal Protection Clause of the Fourteenth Amendment.
8. Roe v. Wade, 1973: The court held that state laws that prohibit abortions except to save the life of the mother were unconstitutional because they violated a right to privacy protected by the Fourteenth Amendment's Due Process Clause. "This right of privacy.is broad enough to encompass a woman's decision whether or not to terminate her pregnancy," declared Justice Harry Blackmun, writing for the majority.
9.Grutter v. Bollinger, 2003: The court upheld the University of Michigan's use of racial and ethnic preferences to increase the numbers of black, Latino and Native American applicants admitted to its law school. Justice Sandra Day O'Connor, writing for the majority, held that "race-conscious admissions policies must be limited in time" and predicted that "25 years from now, the use of racial preferences will no longer be necessary."
10. Lawrence v. Texas, 2003: The court struck down state anti-sodomy laws, deeming them a violation of the Due Process Clause of the Fourteenth Amendment. The majority opinion by Justice Anthony Kennedy said decisions relating to marriage, procreation, and child rearing are constitutionally protected and "persons in a homosexual relationship may seek autonomy for these purposes, just as heterosexual persons do."
