ว่าจะไม่โพสต์อะไรแล้ว เพราะอยากให้ Status เรื่องไผ่ดาวดิน นักศึกษา นิติ มข.ผู้ประสบกับโศกนาฎกรรมแห่งกระบวนการยุติธรรม เป็น Status สุดท้าย ในการไว้อาลัย การดำเนินการของกระบวนการยุติธรรมไทยอย่างน่าเศร้าใจ และเป็นหลักฐานแห่งการละเมิดทั้งหลักจริยธรรมของการใช้อำนาจหน้าที่ของบุคลากรในกระบวนการยุติธรรม การละเมิดกติกาสากล และข้อสันนิษฐานว่าบุคคลย่อมบริสุทธิ์จนกว่าศาลจะพิพากษาถึงที่สุดว่าเขากระทำผิด อันจะปฏิบัติต่อเขาอย่างผู้กระทำผิดไม่ได้ ซึ่งไผ่ ดาวดิน ตรงกันข้าม ถูกกระทำยิ่งกว่าผู้ต้องโทษประหาร ไม่ว่าจะคดีจ้างวานฆ่า หรือคดีร้ายแรงใด ๆ ที่สามารถได้รับการประกันตัวได้ อย่างสบาย ๆ โดยองค์กรสูงสุดในกระบวนการยุติธรรมออกมาประกาศว่า เธอยังเป็นผู้บริสุทธิ์อยู่ ต้องได้รับการประกันตัว

อย่างไรก็ตาม มีคนถามว่า ผมไว้อาลัยต่อกระบวนการยุติธรรมเรื่องอะไร ซึ่งผมจะมีคำถามกลับไปว่า "ไปอยู่ไหนมา ทำไมไม่รู้อะไรเลย" หลายคนเตือนว่า ใจเย็น ๆ เงียบ ๆ เดี๋ยวทุกอย่างจะดีขึ้น เดี่ยวจะเดือดร้อนเอง ฯลฯ ผมว่า เสียงแห่งสามัญสำนึก ในจริยธรรมนักกฎหมาย มันเรียกร้องให้ต้องกระทำ อย่างน้อยก็ประกาศว่าไม่เห็นด้วย เศร้าใจ และเสียใจต่อหลักคำสอนที่ได้เคยร่ำเรียนมาถูกย่ำยีซ้ำแล้วซ้ำเล่า ที่สำคัญ ผมอยากมองหน้าตัวเองในกระจกได้อย่างภาคภูมิใจว่า ผมได้ทำตามจิตสำนึกที่ได้ร่ำเรียนมาแล้ว ผมนิ่งเฉย อย่างนักกฎหมายใหญ่ ๆ ที่สอนผมให้เคารพ ยึดมั่น ในหลักจริยธรรมมาโดยตลอดไม่ได้หรอก ละอายใจตนเอง

ผมไว้อาลัยต่อกระบวนการยุติธรรม กรณีของไผ่ ดาวดิน เพราะผมเชื่อว่า ทุกคนควรได้รับความเคารพในศักดิ์ศรีความเป็นคนเหมือน ๆ กัน

ไผ่ ดาวดิน ได้สร้างคุณประโยชน์ต่อสังคม คนจน และชาวบ้านในหลายท้องที่ ให้ต่อสู้กับ สัมปทานเหมืองทอง ที่ชาวบ้านทุกข์ระทมแสนสาหัส

ไผ่ ดาวดิน ได้ทำหน้าที่ของคนโดยสมบูรณ์ยิ่งกว่าใคร ๆ เขาได้แสดงจุดยืนของนักกฎหมายที่ไม่อาจยอมรับอำนาจไม่ชอบธรรมได้ เขาแจกเอกสารคำอธิบายร่างรัฐธรรมนูญ ซึ่งไม่มีการบิดเบือน แต่โดนจับและถูกขังมาอย่างต่อเนื่อง

ไผ่ ดาวดิน แชร์บทความ ใน BBC ประเทศไทย เขาคือ 1 ใน 2700 คนที่แชร์ แต่มีเพียงเขาที่ถูกดำเนินคดี ในขณะที่ BBC ต้นเรื่อง กลับได้รับอภิสิทธิ์ ไม่ถูกดำเนินคดีใด ๆ

ไผ่ ดาวดิน ถูกเพิกถอนประกันในคดีก่อน ในข้อหาเย้ยหยันอำนาจรัฐ ผมก็เพิ่งรู้ว่า มีข้อหานี้ในระบบกฎหมาย เพิ่งเคยได้ยินครั้งแรกในชีวิต รัฐ และศาลบอกว่า เขาไม่ยอมลบบทความดังกล่าวตามคำสั่ง ซึ่งจริง ๆ ไม่เคยมีคำสั่งใด ๆ

ไผ่ ดาวดิน ถูกสั่งอนุญาตให้ฝากขัง โดยเขาไม่อยู่ร่วมกระบวนการในการฝากขัง ซึ่งการกระทำดังกล่าวผิดกฎหมาย

ไผ่ ดาวดิน ต้องสอบวิชา คอมพิวเตอร์ เพื่อให้สามารถจบการศึกษาได้ แต่เขาไม่ได้รับการประกันตัวเพียงเพื่อไปสอบ ??? ทำไม จึงซ้ำเดิม ชีวิตกันได้ขนาดนี้ ทั้ง ๆ ที่การแชร์ข้อความ มันไม่ได้ร้ายแรงกว่า จ้างวานฆ่าคนตายเลย ทำไม ปล่อยให้ประกันตัวในคดีจ้างวานฆ่าได้ แต่ปล่อยเพื่อไปสอบไม่ได้ เอาหลักกฎหมายอะไรมาวินิจฉัย และที่สำคัญ ใจดำเกินไปไหม ???

ถ้าเราเพิกเฉย ต่อความอยุติธรรมที่เกิดขึ้นได้ เราแม่งไม่ใช่คนแล้วละครับ และที่สำคัญ สิ่งเหล่านี้ มันอาจจะเกิดกับลูกหลานเราได้ ทุกคน คือ ไผ่ มีสถานการณ์อย่างเดียวกัน ที่จะถูกละเมิดได้ตลอดเวลา เราเอาความมั่นใจจากไหนว่า วันนึง อยู่ดีๆ จะไม่ถูกข้อหาแบบนี้ ??

หากเราเพิกเฉยต่อการละเมิด เราจะมองหน้าตัวเองในกระจกได้หรือ ผมก็อยากรู้ว่า คนที่มีส่วนร่วมในการกระทำละเมิดครั้งนี้ ตอบจิตใต้สำนึกตัวเองได้หรือไม่ ถ้าคนเหล่านั้น เขามีความสุขที่ได้ทำ เขาไม่มีหัวใจแล้ว

ปล. ไม่ต้องถามอีกว่า ไว้อาลัยเรื่องอะไร ผมจะทิ้ง Status นี้ไว้แบบนี้ จนกว่า ความยุติธรรม มันจะเกิดขึ้นจริงในประเทศไทย และถ้าคุณคิดว่า คุณเป็นคนมากพอ คุณต้องกล้าที่จะเปล่งเสียงเบา ๆ ของเราออกไป ให้ไปถึงผู้มีอำนาจหน้าที่ได้รู้ เผื่อว่าจะไปสะกิดต่อมความดี ที่เขาอาจจะยังมีอยู่ ให้แก้ไขปัญหาที่เกิดขึ้นให้ดีขึ้น ก่อนที่ทุกอย่างจะสายไป

ปล.๒ แล้วอย่ามาใช้ธรรมกลบปัญหา ทำนองว่า "ความยุติธรรมไม่มีอยู่จริงหรอก ความยุติธรรมอยู่ที่ใจตนเอง ใจสงบ ทุกอย่างจะดีเอง" อย่ามาพูดแบบนั้นเลย มันไม่เข้าท่าเลย โดยเฉพาะคนพูดที่เป็น นักกฎหมาย ทนายความ ตำรวจ อัยการ และศาล ถ้าคิดแบบนั้น ผมว่าเลิกเป็นเถอะ คืนปริญญากฎหมายไป

My intention is not to post anything anymore until the justice appears in Thailand again. However, many of my friends ask the similar question what I have to make condolence for? I have them back where they are and why they never realize injustice is widespread throughout Thailand demonstrating clearly in Pai Dow Din case.

Pai Dow Din case is badly simply example of injustice which becomes the evidence of severe human right violation in Thailand as well as the discrimination against him alone with the bad faith to make him subject to disaster in his life. The result of this case also chill the others from action against the corrupted and dictatorship government.

I do pay condolence to the worst injustice of Thailand in this case because I believe that I strongly believe that all human are created equal and everyone should be respected in his human dignity equally.

Pai has contributed himself to society in rural area; he had been fighting together with the poor against gigantic company that invested in gold industry which made the poor got sick and subject to many problems.

Pai's behaviors are complete than any other human; he stands on his firm point to against the coup and dictatorship, especially before the constitutional draft referendum in 2016 by sharing his explanation of such constitution to the people but he was arrested alone while the government can broadcast their opinion about the draft without any problem. He is also detained for a long time and the case is during trial.

Pai has shared a-BBC Thailand-article which is accused as a crime under the lesse majeste law, article 112 of Thailand Criminal Code. He is the only one in 2700 persons who shared it but he alone has been arrested while the others including BBC has never been touched.

Pai, who got freedom on bail by the court in the other case has, has been arrested again and the bail has been revoked by the court because of sharing such article. The Court gave the reason for revocation that Pai had demonstrated that he did not scare to the state authority by sharing such article and never deleted it as the condition of bail. In fact, there is no condition and there is no court order to delete it before revocation.

After he was continuously detained during police investigation, the court permit the correction to detain him due to the investigator's motion without his appearance which violate the Criminal Procedure Code demanding the defendant must appear before the court, but his right became zero.

Moreover, all trail of detention motion of police investigator is doing in secret fashion. This violate the principle of fair and public trial. He is still detained by the reason that if he got freedom on bail he might destroy the evidence. It is impossible because his article sharing is on the computer system and has been collected by the officer. How can he destroy such evidence?

Pai also had subjected to undesirable behavior; for instance, he did not have lunch on time during the detention motion period, but he got "food" at 3 pm. This can be called "humanitarianism" or treatment as human ?

Pai will be thoroughly check his body including his anus every time the correction guard brought him to go and back to court by the pretext of drug prevention. Here is human conduct ?

Pai still is a student at Khon Khan Law School University. He has been detained and he would like to get a bail only for taking his final exam, but the court and correction deny to let him take it in practice. Why Thais kill the small Thai like him? Why do the other serious cases like premeditated conspired murder can be presumed innocent, and the murder goes free on bail, but not Pai who would like to take an exam? What is the legal standard for this situation? What a shameful legal professionalism they are?

There are numerously undesirable situations that he must subject to, either renowned legal professor feel it is serious case at all. What the F happens?

If we can ignore for an abnormal justice, we are not a man. Injustice which happens anyplace means that it can occur to anyone everyplace. How can we feel secure that nothing like this will not happen to our relatives and ourselves?

If we can ignore to those unfair practice, how can we look into our eyes when we see the mirror? I feel doubtful if the persons involving in an injustice process still feel happy? How can do answer to their voice of consciousness? Or they nothing about it? or they have no heart?

Finally, please do not ask me again why do pay attention and condole for this injustcie. I will leave my status at this point till the justice comes back to Thailand. I hope that the persons in charge will coincidentally pass through my page and read this opinion, and thus trigger their heart a little bit. Importantly, I would like to do have a thin hope that they will change their minds and resolve the wrong things they did right now. Please better it before it becomes too late.

Again, do not be too sanctimonious by saying that "keep calm in your mind, everything will be better." It cannot better justice in our society. Do not say it especially you are a person who get a law degree. If you think so, through your certificate a way.

If you cannot think, imagine that if your relatives subject to bad situation like, how do you feel? Acceptable? Feel and Stay with the present?
