เมื่อไม่กี่วันมานี้มีข่าวใหญ่เรื่องการฟ้องร้องเรียกค่าล่วงเวลาจำนวน 10 ล้านดอลลาร์ ของพนักงานขับรถส่งของ คดีนี้ฟ้องกันที่ศาลอุทธรณ์ สหรัฐอเมริกา

ประเด็นที่ฟ้องคือฝั่งพนักงานบอกว่าตัวเองต้องได้ค่าล่วงเวลา 1.5 เท่าของอัตราค่าจ้างปกติตามกฎหมายของรัฐเมน  แต่กฎหมายของรัฐระบุว่างานต่อไปนี้จะไม่ได้ค่าล่วงเวลา “The canning, processing, preserving,freezing, drying, marketing, storing, packing for shipment or distribution of:(1) Agricultural produce; (2) Meat and fish products; and (3) Perishable foods.”

ปัญหามันอยู่ตรงการตีความคำว่า packing for shipment or distribution of ซึ่งเนื่องจากคำนี้ไม่มีเครื่องหมายserial comma (a comma placed immediately before the coordinating conjunction (usually and or or) in a series of three or more terms) ทำให้ตีความได้ว่าสองอย่างนี้เป็น 1 หน้าที่  ฝ่ายพนักงานขับรถแย้งว่า พนักงานขับรถไม่มีหน้าที่แพ็กของ(packing for shipment) มีแค่หน้าที่ขับรถส่งของเท่านั้น (distribution) ดังนั้นตนไม่เข้าข่ายยกเว้นจากการได้รับค่าล่วงเวลา (เพราะไม่ได้ทำกิจกรรม packing for shipment or distribution of แต่ทำแค่ distribution ซึ่งไม่ใช่ชื่อกิจกรรมที่ระบุไว้ว่ายกเว้น)

ในคำพิพากษา ช่วงกลางๆระบุว่าคู่มือร่างกฎหมายของรัฐไม่ได้ใช้ comma ก่อนคำสุดท้ายของวลี   แต่พอไม่ใช้แล้วก็เกิดความกำกวมอย่างในคดีนี้  (They acknowledge that the drafting manual advises drafters not to use serial commas to set off the final item in a list -- despite the clarity that the inclusion of serial commas would often seem to bring.)

ข้อโต้แย้งอีกอย่างหนึ่งคือหาก distributionof perishable goods เป็นงานเดียวกันกับ packing คำนี้ควรจะเขียนโดยใช้รูป gerund ว่า distributing (Next, the drivers point to the exemption's grammar. The drivers note that each of the terms in Exemption F that indisputably names an exempt activity -- "canning, processing, preserving," and so forth on through "packing" -- is a gerund. By, contrast, "distribution" is not.) แต่เนื่องจากไม่ได้เขียนโดยใช้ gerund เหมือนคำข้างหน้าที่เขียนแบบนี้ต่อๆ กันมายิ่งทำให้ตีความได้ว่าเป็นคนละงานกันและไม่ใช่งานที่ได้รับยกเว้นจากค่าล่วงเวลา
