ส.ส.ร. กับ Advisor ของผม ในการร่างรัฐธรรมนูญใหม่ของไทย
ท่านคงจะได้ทราบไปแล้วว่า ได้มีการโปรดเกล้าฯ แต่งตั้ง ส.ส.ร. เพื่อร่างรัฐธรรมนูญใหม่กันเรียบร้อยแล้ว ผมโคตรสงสัยเลยว่า ทำไม คณะ คมช. ต้องการที่จะร่างรัฐธรรมนูญให้เสร็จไปในคราวที่ยังครองอำนาจอยู่ ไม่ทราบทำไม กลัวกับกระบวนการร่างรัฐธรรมนูญ แบบประชาธิปไตยนัก กลัวดาบคืนสนองหรือครับ ที่ปล้นประชาธิปไตยมาเนี่ย
ทั้งกระบวนการสรรหา .... ตลอดจน รายชื่อสมาชิก ส.ส.ร. แล้ว เห็นแล้วก็ต้องตกใจ ผมไม่ได้ดูถูกหรอก แต่นี่มันเป็นการร่างกฎเกณฑ์ของการอยู่ร่วมกันของคนทั้งประเทศ ตามระบอบประชาธิปไตย แล้วเอาใครมาร่างกันกันนี่ แล้วหากท้ายที่สุดประชาชน ลงประชามติ ไม่เอา รัฐธรรมนูญฉบับนี้แล้ว ก็ให้อำนาจเด็ดขาด คมช. หยิบรัฐธรรมนูญในอดีต เป็นต้นว่า คมช. อาจจะเอา รัฐธรรมนูญฉบับ จอมพล ที่ครองอำนาจยาวนานนับสิบปี มาใช้ได้ .... วันนั้น คนไทยจะเริ่มสำนึก กันเสียที สนับสนุนกันดีนัก รัฐประหาร ...
คมช. ควรจะปล่อยให้ การร่างรัฐธรรมนูญ เป็นไปตามกระบวนการตามระบอบประชาธิปไตย อย่างที่ รัฐธรรมนูญ ฉบับปี ๔๐ ได้ปฎิบัติมา ไม่เห็นต้องรีบร้อนให้ร่างด้วยคณะที่ตอนครอบงำอยู่ เช่นนี้ สุดท้าย น่าเชื่อว่า รัฐธรรมนูญฉบับใหม่ จะไม่เหลือบทบัญญัติว่า นายกฯ ต้องมาจาก สส. ที่ผ่านระบบการเลือกตั้ง สว. เป็นข้าราชการประจำได้ ฯลฯ เพื่อที่จะได้พวกพ้องของตนได้เป็น สว. ในอนาคตต่อไป ได้แต่หวังว่า คณะผู้ร่างฯ จะไม่ลืมเลือดเนื้อของคนที่ต่อสู้เพื่อให้ได้มาซึ่งหลักการประชาธิปไตยเมื่อ ปี ๓๕ ... เขาคือ พี่น้องเพื่อร่วมชาติของคุณทั้งนั้นครับ แม้จะไม่รู้จัก ไม่เคยเห็น ไม่เคยคุย กันก็ตาม
อีกเรื่องหนึ่ง คือ Professor Tom Ginsburg แห่ง College of Law University of Illinois ซึ่งเป็น Advisor ของผม ได้รับเชิญไปบรรยายให้ความรู้กับกระบวนการร่างรัฐธรรมนูญ ที่เป็นประชาธิปไตย ระบบการประกันความเป็นอิสระขององค์กรต่าง ๆ รวมถึงประเด็นปลีกย่อยต่าง ๆ ให้แก่คณะผู้ร่าง และนักการเมืองของไทย รวมถึงที่สถาบันพระปกเกล้าฯ ด้วย ในช่วงต้นปีที่ผ่านมา
ผมหวังว่า หลักการที่ Advisor ของผม ได้พูดให้เขาเหล่านั้นฟัง มันจะซึมเข้าไปในจิตสำนึก ของพวกเขาบ้าง ไม่อยากให้มันเหมือน เอาน้ำรดลงบนตอไม้ รดลงเท่าไหร่ ก็ไม่มีวันโต ... หวังว่าเขาทั้งหลาย จะเข้าใจ แล้วร่างรัฐธรรมนูญ ให้มันออกมาเป็นประชาธิปไตยให้ได้ ....
Professor Ginsburg provides expertise as Thailand prepares to write a new Constitution
Professor Tom Ginsburg, the Director of the Program in Asian Law, Politics and Society, gave multiple presentations from January 3-6, 2007 on "Constitutions: Issues for Consideration" in Bangkok and the northern city of Chiang Mai as Thailand beings to write a new constitution in preparation for a return to democratic rule. On January 3, Professor Ginsburg, a Professor of Law and Political Science, gave a presentation to 25 Thai diplomatic service officers in the North American division of the Thai Ministry of Foreign Affairs; later in the day he gave a presentation to 40 officers at the Justice Officials Training Institute.
The following day, Professor Ginsburg traveled to Chiang Mai and gave a luncheon presentation, hosted by Consul General Beatrice Camp, to 25 leading academics, government officials and civil society leaders; in the afternoon he made a similar presentation at the American Corner at Chiang Mai University to 70 students from several universities in Chiang Mai.
On January 5 and 6, Professor Ginsburg was the keynote speaker and panelist at a seminar hosted by King Prajadhipok's Institute (KPI), one of Thailand's leading think tanks, that was attended by over 100 invited guests, including several members of the Constitution Drafting Council, leading academics, media figures, political party activists, civil society/NGO leaders, local administrators, private sector representatives, and representatives from independent agenciesthe Administrative & Constitutional Courts, Office of the National Counter Corruption Commission, Office of the National Human Rights Commission, and the Office of the Ombudsman. Seminar topics included "Checks and Balances," "Independence and Oversight of the Exercise of State Power," and "Political Parties, Elections and the Exercise of Legislative Power."
Professor Ginsburgs program with KPI was covered by several leading Thai newspapers and on primetime television news programs, including Matichon (readership: 675,000), Thai Rath (readership: 11,500,000), Daily News (readership: 5,700,000), Krungthep Turakit (readership: 110,000), Bangkok Post (English-language newspaper; readership: 100,000), and on four Thai national television stations.
Professor Ginsburg arrived in Thailand in the midst of the final preparations of the selection of the new Constitution Drafting Council (CDC), which convened on January 8, 2007. The speaker program was designed to inform Thai audiences about the U.S. Constitution and the American constitutional system, while also presenting ideas about different constitutional systems and issues that Thais may wish to consider when drafting its new constitution.
In a diplomatic report to the U.S. State Department, it was noted that Professor Ginsburg's clear speaking, well-organized presentations, encyclopedic knowledge of the U.S. Constitution, as well as his broad knowledge of constitutions from around the world, resulted in Thai audiences gaining a stronger understanding of the U.S., as well as the implications of various constitutional issues for Thailand. With members of the CDC in the audience, the report concluded that Professor Ginsburgs presentation has potential long-term impact on the constitution that Thailand eventually approves.
Professor Ginsburg is currently co-directing "The Comparative Constitutions Project" with Professor Zachary Elkins (Political Science). The goal of the project is to collect data on the formal characteristics of written constitutions, both current and historical, for most independent states since 1789. Characteristics include aspects of both form and content of these documents. The project is housed at The Center for the Study of Democratic Governance.
