He had little to do with the Egat ruling, he said, simply because his court was governed and guided by principles, not individual wills. When reminded that the Egat policy carried very high political, economic and financial stakes, the courts president simply pointed out that this kind of dilemma was the reason why his institution came into existence in the first place. He wouldnt accept the courageous tag endowed on his court by opponents of the Thaksin government. Its not about being independent or brave or bold, he insisted. Its about being just and trying ones best to be so. No matter how they see themselves, the judges are some of the few good men in our comatose system of checks and balances. We selected Ackaratorn as our Person of the Year not because the institution he presides over has stopped the dubiously motivated Thaksin administration in its tracks, but because his court has done well in serving its noble purpose. The judges, who are supposed to ensure that state policies, laws and actions - all of which are backed by so-called political legitimacy - are not abused or generate ill effects on any Thai citizen, have stuck well to their daunting task. From the mammoth case of the Egat IPO, down to the suffering of individual hill-tribe people, the court has won praise for being rigid on constitutional values and flexible on implementation of secondary laws that might infringe on public liberty or well-being. The government always has the major edge when it comes to interpretation or clarification of laws, Ackaratorn said. The injunction stopping the Egat IPO reflected the principles upon which the Supreme Administrative Court was founded - that the publics interest shall always be protected, regardless of the political consequences. Those principles have been frequently disregarded, or virtually mocked in some cases, by other constitutional establishments that are supposed to be independent. The Constitution Court, for instance, has shamed itself with highly questionable rulings that have scorned real democratic and constitutional values. We have also lost our faith in the Election Commission and the National Counter Corruption Commission. Amid the growing shadow of government domination and threats against liberty, the Supreme Administrative Court has always been there. In June 2002, it handed down a historic ruling on the Thaksingate scandal in the most telling manner. The Anti-Money Laundering Office (AMLO), the court said, had carried out an illegal probe into the banking transactions of journalists critical of the government, and the investigation infringed upon their civil rights. Ackaratorn said politicians in power always harboured the misunderstanding that they could do anything that was not illegal. Basic political science, in fact, stipulates that every government action needs to be backed up by the law, and that is why AMLOs citation of an anonymous leaflet to justify its move against the journalists smacked of power abuse. For all Ackaratorns insistence about his institutions neutrality, the court has become a source of hope for people who think its one of the few potent forces to counterbalance the Thaksin government. That expectation is not only unreal, but also inappropriate, he said, because our only task is to make sure, when there are complaints, that state legal power is not abused or misused, and that the will of the Constitution is not violated. We did not set out to counter anybody. But, according to the government, the court seemed to have instigated anarchy.
