รัฐธรรมนูญสหรัฐฯ มาตรา ๔) ว่าด้วยความสัมพันธ์ระหว่างมลรัฐ
รัฐธรรมนูญสหรัฐฯ ได้แสดงนัยยะสำคัญว่า กฎหมายของรัฐใดรัฐหนึ่ง ควรได้รับการยอมรับให้มีค่าบังคับ จากทุกมลรัฐไปในทางเดียวกัน โดยองค์กรศาล [Chicago & A. Railroad v Wiggins Ferry Co. (1887) 119 US 615, 30 L Ed 519, 7 S Ct 398.]
บทบัญญัติในมาตรานี้ กำหนดให้กระบวนการทางศาลในแต่ละรัฐ จะต้องให้ความเคารพอย่างสูงสุดต่อกระบวนการดำเนินคดีของศาลอื่น ๆ อย่างสุดกำลัง แต่บทบัญญัตินี้ ก็ไม่ถือเป็นเครื่องมือในการบังคับให้รัฐใดรัฐหนึ่ง ต้องยอมรับเอากฎหมายของรัฐอื่นมาเป็นของตนเอง
ในการบังคับให้เป็นไปตามคำพิพากษาของศาลในมลรัฐที่เกี่ยวข้อง คำพิพากษาที่ตัดสินในรัฐหนึ่ง ย่อมจะได้รับการยอมรับให้มีผลบังคับในรัฐอื่น แม้ว่าฐานความผิดหรือประเด็นข้อพิพาทนั้น จะไม่ได้ถูกบังคับในรัฐที่ทำการพิจารณาคดีก็ตาม และข้อความข้างต้น มีผลบังคับทางกฎหมาย โดยไม่ต้องมีข้อตกลงระหว่างมลรัฐกันแต่ประการใด
ในกรณีที่มีการฟ้องร้องกันในประเด็นเดียวกันในหลายมลรัฐ คำพิพากษาใด ที่ตัดสินมาก่อน ยอมถือเป็นที่สุด และ จะต้องรับการยอมรับให้มีผลเป็นการบังคับใช้อย่างปราศจากเงื่อนไข [ Hanson v Denckla (1958) 357 US 235, 2 L Ed 2d 1283, 78 S Ct 1228, reh den (1958) 358 US 858, 3 L Ed 2d 92, 79 S Ct 10.]
อย่างไรก็ตาม บทบัญญัติ รัฐธรรมนูญของสหรัฐฯ มาตรา ๔) เป็นการสร้างกฎเกณฑ์เกี่ยวกับการรับฟังพยานหลักฐาน (rule of evidence) มากกว่าการกำหนดเขตอำนาจของศาล แต่ไม่ได้กำหนดให้มีการ uniform คำพิพากษาของศาลให้เหมือนกันหมดในทุก ๆ มลรัฐ เพราะรัฐแต่ละรัฐ มีอิสระในการกำหนดกฎเกณฑ์ทางกฎหมายในเขตอำนาจรัฐนั้น ๆ อยู่แล้ว
นอกจากนี้ มาตรา ๔) ยังมีข้อกำหนด เรื่องอื่น ๆ เช่น การส่งมอบทาส ที่หลบหนีจากรัฐหนึ่งไปยังรัฐหนึ่ง (ซึ่งปัจจุบัน อนุมตรานี้ ไม่มีผลบังคับใช้แล้ว เพราะสหรัฐฯ เลิกทาสตั้งแต่ ปี ค.ศ. ๑๘๖๔) การช่วยเหลือมลรัฐ ให้รอดพ้นจากการถูกรุกรานจากต่างประเทศ เป็นต้น
สำหรับเนื้อหาของรัฐธรรมนูญสหรัฐฯ มาตรา ๔ (ARTICLE IV. RELATIONS BETWEEN STATES) มีดังนี้ Sec. 1. Full Faith and Credit.
Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof.
Sec. 2, Cl 1. Privileges and immunities of citizens.
The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States.
Sec. 2, Cl 2. Delivery of fugitives.
A Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on Demand of the executive Authority of the State from which he fled, be delivered up, to be removed to the State having Jurisdiction of the Crime.
Sec. 2, Cl 3. Runaway slaves.
No Person held to Service or Labour in one State, under the Laws thereof, escaping into another, shall, in Consequence of any Law or Regulation therein, be discharged from such Service or Labour, but shall be delivered up on Claim of the Party to whom such Service or Labour may be due.
Sec. 3, Cl 1. Admission of new states.
New States may be admitted by the Congress into this Union; but no new State shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or Parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress.
Sec. 3, Cl 2. Territory or property of United States.
The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States; and nothing in this Constitution shall be so construed as to Prejudice any Claims of the United States, or of any particular State.
Sec. 4. Form of State governments--Protection.
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
